Paid Holiday to employees on the day of Poll

Election Commission of India has declared to grant of paid holiday to employees on the day of poll in Punjab, Goa, Manipur, Uttar Pradesh and Uttarakhand.

The General Elections to the Legislative Assemblies of Goa, Manipur, Punjab, Uttar Pradesh and Uttarakhand, 2012. As per the section 135B of the Representation of the People Act, 1951, which provides for the grant of paid holiday to the employees on the day of poll. The rule of section 135B says,
(i)  Every person employed in any business trade, industrial undertaking or any other establishment and entitled to vote at election to the House of the People or the Legislative Assembly of a State shall, on the day of poll, be granted a holiday.

(ii) No deduction or abatement of the wages of any such person shall be made on account of a holiday having been granted in accordance with sub-section (1) and if such person is employed on the basis that he would not ordinarily receive wages for such a day, he shall nonetheless be paid for such day the wages he would have drawn had not a holiday been granted to him on that day.

(iii)  If an employer contravenes the provisions of sub-section (1) or sub-section (2), then such employer shall be punishable with fine, which may extend to five hundred rupees.

(iv)  This section shall not apply to any elector whose absence may cause danger or substantial loss in respect of the employment in which he is engaged."

Subject: Declaration of holiday under Negotiable Instrument Act for Central Government Offices, including Central Public Sector Undertakings, located in Gurgaon, Faridabad, NOIDA and Ghaziabad on the 14th October, 2010 on the occasion of Closing Ceremony of the Commonwealth Games-2010.

In continuation of this Departments 0.M of even No. dated 7/7/2010, it has further been decided to declare Thursday, the 14th October 2010, as a Holiday for Central Government Offices, including Central Public Sector Undertakings, located in Gurgaon, Faridabad, NOIDA and Ghaziabad on the occasion of Closing Ceremony of the Commonwealth Games - 2010.

14 holidays next year for Central Government Employees

14 holidays next year for Central Govt staff

Central government employees will get 17 holidays next year but three of them fall either on a Saturday or Sunday.

According to a list of holidays drawn up for 2011, which released well in advance, three holidays — Mahavir Jayanti (April 16), Mahatma Gandhi’s birthday (October 2) and Christmas (December 25)— fall on Saturday or Sunday, leaving only 14 effective holidays. For employees in Delhi, three days are added to the list as restricted holidays — Maha Shiv Ratri, Ram Navmi and Janmashtmi. The total restricted holidays for the government employees are 35, though 10 of them fall on Saturdays or Sundays when the offices are already closed and hence no need of any employee seeking the particular holiday.

CIC to ask govt for more RTI cells The Central Information Commission will soon ask the government to set up a RTI cell in each department and appoint senior officials as Central Public Information Officers to better response to RTI pleas.

The decision was made at a meeting of the information commission on basis of suggestions of a RTI applicant Satinder Pal Chopra of Bhopal.

Declaring a holiday for Central Government offices located in Delhi/New Delhi on 14th October 2010 under the Negotiable Instrument Act on the occasion of Closing Ceremony of Commonwealth Games-2010

The Union Cabinet today approved declaration of a holiday for Central Government offices, including Central Public Sector Undertakings, located in Delhi/New Delhi on the 14th October 2010 (Thursday) under explanation to Section 25 of the Negotiable Instruments Act, 1881 on the occasion of Closing Ceremony of Commonwealth Games 2010.

This decision will facilitate the movement of traffic and ensure greater participation of public in the closing ceremony of the Commonwealth Games -2010.

The Commonwealth Games are scheduled to be held between 3rd – 14th October , 2010 in Delhi. The opening Ceremony of the games will be held at Jawaharlal Nehru Stadium on Sunday, the 3rd October and the Closing Ceremony will be held on Thursday, the 14th October 2010 at the same venue.

Subject: Holidays to be observed in Central Government offices during the year 2011.

It has been decided that the holidays as specified in the Annexure -I to this O.M. will be observed in all the Administrative Offices of the Central Government located at Delhi/New Delhi during the year 2011. In addition, each employee will also be allowed to avail himself/herself of any two holidays to be chosen by him/her out of the list of Restricted Holidays in Annexure - II.

2. Central Government Administrative Offices located outside Delhi / New Delhi shall observe the following holidays compulsorily in addition to three holidays as per para 3.1 below:

The final list applicable uniformly to all Central Government offices within the concerned State shall be notified after seeking prior approval of this Ministry and no change can be carried out thereafter. It is also clarif~ed that no change is permissible in regard to festivals and dates as indicated.

3.2 No substitute holiday should be allowed if any of the festival holidays initially declared subsequently happens to fall on a weekly off or any other non- working day or in the event of more than one festivals falling on the same day.

4. The list of Restricted Holidays appended to this O.M. is meant for Central Government Offices located in Delhi / New Delhi. The Coordination Committees at the State Capitals may draw up separate list of Restricted Holidays keeping in view the occasions of local importance but the 9 occasions left over, after choosing the 3 variable holidays in para 3.1 above, are to be included in the list of restricted holidays.

5.1 For offices in Delhi / New Delhi, any change in the date of holidays in respect of Idu'l Fitr, Idu'l Zuha, Muharram and Id-e-Milad, if necessiuy, depending upon sighting of the Moon, would be declared by the Ministry of Personnel, Public Grievances and Pensions after ascertaining the position from the Govt. of NCT of Delhi.

5.2 For offices outside Delhi / New Delhi, the Central Government Employees Welfare Coordination Committees at the State Capitals are authorised to change the date of holiday, if necessary, based on the decision of the concerned State Governments / Union Territories, in respect of Idu'l Fitr, Idu'l Zuha, Muharram and Id-e-Milad.

5.3 It may happen that the change of date of the above occasions has to be declared at a very short notice. In such a situation, announcement could be made through T.V. / A.I.R. / Newspapers and the Heads of Department / Offices of the Central Government may take action according to such an announcement without waiting for a formal order, about the change of date.

6. During 2011, Diwdi (Deepavali) falls on Wednesay, October 26, 2011 (Kartika 04). In certain States, the practice is to celebrate the occasion a day in advance, i.e., on "Narakachaturdasi Day". In view of this, there is no objection if holiday on account of Deepavali is observed on 'Naraka Chaturdasi Day (in place of Deepavali Day) for the Central Government Offices in a State if in that State that day alone is declared as a compulsory holiday for Diwali for the offices of the State Government. However, in the year 20 1 1, Diwali (Deepavali) and Narak Chaturdasi Day, both are falling on the same day i.e. October 26, 2011.

7. Central Government Organisations which include industrial, commercial and trading establishments would observe upto 16 holidays in a year including three national holidays viz. Republic Day, Independence Day and Mahatma Gandhi's birthday, as compulsory holidays. The remaining holidays / occasions may be determined by such establishments / organisations themselves for the year 2011, subject to para 3.2 above.

8. Union Territory Administrations shall decide the list of holidays in terms of Ministry of Home Affairs letter No.14046/27/83- GP-I dated 15.2.1984 by which they would observe a total of 16 holidays including the three National Holidays Viz. Republic Day, Independence Day & Mahatma Gandhi's birthday.

9. In respect of Indian Missions abroad, the number of holidays may be notified in accordance with the instructions contained in this Department's O.M. No.12/5/2002-JCA dated 17^th December, 2002. In other words, they will have the option to select 12(Twelve) holidays of their own only after including in the list, three National Holidays and Mahavir Jayanti, Christmas Day included in the list of compulsory holidays and falling on days of weekly off.

10. In respect of Banks, the holidays are restricted to 15 days in a year in terms of the instructions issued by the Department of Economic Affairs (Banking Division).

OFFICE MEMORANDUM

  

Subject: Declaration of Holiday on 14th April, 201& Birthday of Dr.B.R.Ambedkar.

  

It has been decided to declare Wednesday, the 14th April 2010, as a Closed Holiday on account of the birthday of Dr. B.R. Ambedkar, for all Central Government Offices including industrial establishments throughout India.

2. The above holiday is also being notified in exercise of the powers conferred by Section 25 of the Negotiable Instruments Act, 1881 (26 of 1881).

3. All Ministries/Departments of Government of India may bring the above decision to the notice of all concerned.

Holidays for Central government offices

Saturday (October 17) and Monday (October 19) have been added to the list of restricted holidays for Central government offices for 2009.

These holidays have been declared on account of Naraka Chaturdasi and Bhai Dhuj respectively, according to a press release.
