KNOW YOUR PAY FIXATION ON PROMOTION & MACP…

Pay fixation is done for an employee if he/she gets a promotion. There is a slight difference of Pay Fixation in Promotion and MACP upgradation…

We are receiving a number of queries as comments regarding the Pay Fixation from the viewers and we try our level best to reply to all queries. But due to non-availability of certain individual information, we are unable to answer everything they have asked for.

As the employees are in different departments of the Central government establishments, the line of promotion (hierarchy) also differs. If any inputs from the departments regarding the line of Promotion and MACP can be obtained from your side, the confusion related to the Promotion and MACP may be clarified.

Clarifications regarding pay fixation of existing Group ‘D’ Employees in the revised pay structure

Subject: Clarifications regarding pay fixation of existing Group ‘D’ Employees in the revised pay structure.

Reference is invited to this Department’s Office Memorandum No. 1/1/2008-IC dated 24th December, 2008 wherein clarifications were provided regarding various aspects of placement of the existing Group ‘D’ employees in the revised pay structure.

2. As per the clarification at Sl. No. 1, those Group ‘D’ employees who did not possess the minimum qualification and who have retired/ died in harness between 1.1.2006 and date of notification of Revised Pay Rules will be granted pay band -1S and the grade pay corresponding to their pre-revised pay scale as notified in CCS (RP) Rules, 2008.

3. The aforesaid issue was raised in the 46th Ordinary Meeting of the National Council (JCM) held on 15th May, 2010 and the Staff Side had requested that the cases relating to the non-matriculate class IV employees who retired or died between January 2006 and August 2008 without any re-training be re-considered and such employees should be granted the benefit by re-fixing their pension/ family pension at par with those employees who were retrained and whose pay was fixed in PB-1 with a grade pay of Rs.1800/-.

4. The request of Staff Side on the subject has been considered and it has been decided that the Group ‘D’ non-matriculate employees who died in harness or have retired between 1.1.2006 and the date of notification of CCS (Revised Pay) Rules, 2008 from those Ministries/Departments which have since re-trained all the eligible serving non-matriculate Group ‘D’ employees and have placed them in PB-1 with grade pay of Rs.1800, would be placed in with grade pay of Rs.1800 with effect from the same date that the retrained eligible employees were placed in this pay band and grade pay.

Subject: Clarifications regarding pay fixation of existing Group ‘D’ Employees in the revised pay structure.

Consequent upon the acceptance of the recommendations of the Sixth Central pay Commission by the Government, related to Group 'D' cadres in Central Government, all existing Group 'D' employees are requested to be upgraded to the pre-revised Group 'C' scale of Rs.2750-4400 corresponding to the grade pay of Rs.1900 (Rs.5200-20200) in the manner prescribed in the CCS (Revised Pay) Rules, 2008 (attention is drawn towards Note 1 below Rule 7 of CCS (Revised Pay) Rules, 2008, which prescribes the procedure for fixation of pay of Group 'D' employees in the revised pay structure). Further, in future, posts will be created only in PB-1 and there shall be no recruitment in -1S pay band save in exceptional circumstances as indicated in para 2.2.10 of the Report of the Sixth Central Pay Commission.

Following the notifications of the CCS (Revised Pay) Rules, 2008, this Department has received references from some administrative departments, seeking clarifications regarding various aspects of placement of existing Group 'D' employees in the revised pay structure. The matter has been considered in this Department. The points of doubt raised by administrative departments and the clarifications thereto are issued as under:



1. How will the pay of those Group 'D' officials who do not posses the minimum qualification and have retired/died in harness from 1.1.2006 till date be fixed in the revised structure? Whether they will be placed in -1S pay band or in the pay band PB-1? Those Group 'D' employees who did not possess the minimum qualification and who have retired/died in harness between 1.1.2006 and date of notification of Revised Pay Rules will be granted pay band -1S and the grade pay corresponding to their pre-revised pay scale as notified in CCS (RP) Rules, 2008.
2. What will be the training curriculum, period and the procedure for placement of those Group 'D' officials in PB-1 band who do not possess the minimum prescribed qualification ? Each administrative department concerned will design a training curriculum suited to its requirements. As far as possible, the training programme should not exceed 3 months and it may be imparted during working days for not more than 2 hours per day. The Department concerned will bear the expenditure for training.
3. In the case of those Group 'D' officials who were in the pre-revised scale of Rs.2550-55-2660-60-3200 (e.g. Peon) and who are to be placed in the pay band PB-1 with Grade Pay of Rs.1800 w.e.f. 1.1.2006 and are subsequently granted ACP/Promotion, it is not clear as to what will be their grade pay. If the grade pay remains unchanged, the officials will not be getting any benefit on promotion/ACP. In case they are granted next higher grade in the hierarchy of revised pay structures, it will put seniors viz Daftry/Senior Peons etc at a disadvantageous position. Government servants who have been granted financial upgradation to a higher scale under the ACP Scheme will be granted the grade pay corresponding to the higher pre-revised pay scale that was granted to them under ACP. However, in case of erstwhile Group 'D' employees, all such eligible employees will be granted grade pay of Rs.1800 in PB-1, irrespective of their pre-revised Group 'D' pay scale whether granted the them on regular appointment/promotion or under ACP.

Reference :- This HQrs Office letter of even No. dated 4/09/2009.

A matter regarding exercising of option for fixation of pay under CCS (RP) Rules'2008 in respect of the individuals who got two promotions between 1/01/2006 and the date of issuing of GOI, Min of Finance Notification dated 29/08/2008, was referred to the Ministry of Defence (Fin)/Min of Finance (Deptt of Expdr) for their clarification.

2. In this connection, Ministry of Finance (Deptt of Expdr) has clarified that" as per CCS (RP) Rules'2008, a Govt. Servant has the option to have his pay fixed from the date of his second promotion, if he/she has been granted two promotions / upgradations between 1/01/2006 and 29/08/2008. In such cases, however, the Govt. servant concerned will not be entitled to draw any arrears of pay w.e.f. I/01/2006 till the date of option.

3. It is, therefore, requested to accept the option for fixation of pay under RPR'2008in respect of the individuals who got two promotions between 1/01/2006 and 29/08/2008and want to switch over in the revised pay structure from the date of second promotionand re-fix the pay of these individuals accordingly.

Pay Fixation on Promotion : Applicability of Minimum Pay / Stepping up of Pay clarification

Subject: Applicability of minimum pay/stepping up of pay clarification reg.

A number of references have been received in this office regarding applicability, for departmental promotees, of minimum entry pay prescribed for direct recruits (appointed on or after 1.1.2006), in Section II of Part A of the First Schedule of RS(RP) Rules, 2008. References have also been received regarding stepping up of pay of senior promotees with references to such of their directly recruited juniors who are recruited on or after 1.1.2006 and whose basic pay is more than that of their seniors.

2. The matter has been examined in consultation with Ministry of Finance. In this connection it is clarified that the revised pay structure comprises grade pays and running pay bands and in the case of those Railway servants who were already in service before 1.1.2006. Sixth Pay Commission has not prescribed a minimum pay in the running pay band with reference to the minimum entry level pay prescribed for direct recruits appointed on or after 1.1.2006. Further, the Sixth CPC has not prescribed minimum pay in the pay band for the purpose of fixation of pay on promotion in the case of any grade and fixing of minimum pay in the pay band in the case of each grade pay for departmental promotees would defeat the very purpose of introduction of running pay bands.

3. As far as the matter relating to bringing the pay of existing Railway servants as on 1.1.2006 at par with the pay of direct recruits recruited on or after 1.1.2006 is concerned, it is clarified that the pay of those Railway servants who joined the Railway as direct recruits on or after 1.1.2006 is to be fixed as per Section II, Part ‘A’ of the First Schedule to the RS(RP) Rules, 2008 and the procedure of pay fixation is based on a specific recommendation of the Sixth Pay Commission, which has been accepted by the Government. As far as pay fixation in respect to those Railway servants who were already in service on 1.1.2006 is concerned, the same is to be done as per the provisions of Rule 7 of RS(RP) Rules, 2008 and in accordance with the fitment tables annexed with this Ministry’s letter No.PC-VI/2008/I/RSRP/1 dated 11.9.2008.

4. In the light of the foregoing, it is clarified that in terms of RS(RP) Rules,2008:-

(a) no minimum pay in the pay band can be prescribed in the case of promotion of Railway servants from one grade to another (except in the case of change in pay band); and

(b) pay of those Railway servants who were already in service on 1.1.2006 can not be fixed with reference to the minimum entry pay prescribed for those who joined the Railways as direct recruits on or after 1.1.2006 as per Section II, Part ‘A’ of the First Schedule to the RS(RP) Rules, 2008.

5. However, stepping up of pay of seniors can be permitted with reference to such of their directly recruited juniors borne on the same seniority list who are recruited on or after 1.1.2006 and whose basic pay is more than that of the seniors, subject to the following conditions:-

(a) Stepping up of the basic pay of seniors can be claimed only in the case of those cadres which have an element of direct recruitment and in cases where a directly recruited junior is actually drawing more basic pay than the seniors. In such cases, the basic pay of the seniors will be stepped up with reference to the basic pay of the juniors. Stepping up will be applicable from the date junior direct recruit is actually drawing higher basic pay than the senior.

(b) Further, Railway servants cannot claim stepping up of their revised basic pay with reference to entry pay in the revised pay structure for direct recruits appointed on or after 1.1.2006 as laid down in Section II of Part A or First Schedule to the RS(RP) Rules, 2008, if their cadre does not have an element of direct recruitment, or in cases where no junior is drawing basic pay higher than them.

(c) Stepping up of pay of the seniors shall not be applicable in cases where pay of direct recruits has been fixed at a higher stage on account of grant of advance increments etc. at the time of recruitment.

6. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Subject:- Revision of the rates of Deputation (Duty) Allowance/payfixation on appointment on the personal Staff of Ministers - regarding.

Consequent upon the implementation of the recommendations of thesixth Central Pay Commission, the President is pleased to decide that in supersessionof all earlier orders on the subject, the pay of employees who are appointed on the personal staff of Ministers will be regulated in the following manner: -
I. OFFICERS OF CENTRAL GOVERNMENT/AUTONOMOUS BODIES APPOINTED ON THE PERSONAL STAFF OF MINISTERS:
(i) When officers of the Central Government/Autonomous Bodies holding posts at lower levels or those who are not cleared for appointments at levels at which the post in the Personal Staff of Minister exists are appointed to higher posts, in addition to their basic pay, they may be allowed Deputation (Duty) Allowance at the rate of 15% of the basic pay subject to a maximum of Rs. 4000 per month.
(ii) As regards officers who go on deputation to equivalent and/or analogous posts on the Personal Staff of the Ministers, in addition to their basic pay, they may be allowed Deputation (Duty) Allowance in accordance with this Department's O.M. No. 2/22 (B)/2008-Estt. (Pay-II) dated 3rd September 2008 on the subject of "Grant of Deputation (Duty) Allowance - Recommendations of the Sixth Central Pay Commission".
(iii) In the case of officers of All-India Services and Organized Group 'A' Services who are appointed on the Personal Staff of Ministers under the Central Staffing Scheme, they may be allowed Central Secretariat (Deputation on Tenure) Allowance in accordance with this Department's O.M. No. 2/22(A)/2008-Estt. (Pay II) dated 3rd September, 2008 on the SUbject of revision of the rates of Central Secretariat (Deputation on Tenure) Allowance and Special Pay applicable etc. in the case of organized Group 'A' officers; and as per the provisions of relevant Pay Rules in the case of All-India Services officers.
II. OFFICERS FROM THE STATE GOVERNMENT/PUBLIC SECTOR UNDERTAKINGS APPOINTED ON THE PERSONAL STAFF OF MINISTERS:
In the case of officers from State Governments/Public Sector Undertakings, their terms of appointment may be governed by the orders contained in this Department's O.M. No. 2/29/91 - Estt. (Pay II) dated 5th January 1994. The rate of Deputation (Duty) Allowance payable in their case will be in accordance with this Department's O.M. No. 2/22(B)/200-Estt. (Pay-II) dated 3rd September 2008 on the subject of "Grant of Deputation (Duty) Allowance - Recommendations of the Sixth pay Commission".
III. OFFICERS FROM PRIVATE SECTOR APPOINTED ON THE PERSONAL STAFF OF MINISTERS:
In the case of officers from Private Sector appointed on the Personal Staff of the Minister, they may be granted the grade pay corresponding to the post in which they are appointed and their pay in the pay band may normally be fixed at the entry level pay prescribed for their grade pay vide Section II, Part A of First Schedule to the CSS (RP) Rules, 2008. However, where it is proposed to fix their pay by granting advance increment(s), the approval of this Department will have to be obtained.
2.Basic pay in the revised pay structure means the pay drawn in the prescribed pay band plus the applicable grade pay but does not include any other type of pay like special pay, etc.
3. These orders shall come into effect w.e.f. 1.9.2008.
4. Insofar as persons serving in the Indian Audit & Account Department are concerned, these orders issue after consultation with the Comptroller & Auditor General of India.

Scheme of revision of pay of teachers and equivalent cadres in universities and colleges and as also for the posts of Registrar, Deputy Registrar, etc.

The Government of Inida, Ministry of Human Resource Development, Department of Higher Education has published anthenticated Fitment Tables (Table No. 1 to 9) for fixation of pay of the existing incumbents, who were in position as on 1.1.2006, in various categories of posts as indicated in the Tables.

Fixation of pay on promotion after 1.1.2006 option under FR 22(I)(a)1

The government orders on implementations of revised pay on 6th CPC recommendations have been issued, in that clarification on FR22(I)(a)1 rule released on 13.10.2008 an anomaly pointed out...

For example: An employee who got promotion after 1.1.2006 opts for promotion date as per rule FR22(I)(a)1 (recommended in Vth pay commission) and gets new basic pay after fixation. Now the same employee gets less basic pay as per the rule of FR22(I)(a)1 (recommended in VIth pay commission) as opts for the promotion date. So the difference between the rule of FR22(I)(a)1 in Vth pay commission and VIth pay commission as be seen. But in selection of Increment date no diffrence has come.

Fixation of pay on promotion on or after 1.1.2006



Fixation of pay on promotion on or after 1.1.2006

In the case of promotion from one grade pay to another in the revised pay structure, the fixation will be done as follows:-

(i) One increment equal to 3% of the sum of the pay in the pay band and the existing grade pay will be computed and rounded off to the next multiple of 10. This will be added to the existing pay in the pay band. The grade pay corresponding to the promotion post will thereafter be granted in addition to this pay in the pay band. In cases where promotion involves change in the pay band also, the same methodology will be followed.

However, if the pay in the pay band after adding the increment is less than the minimum of the higher pay band to which promotion is taking place, pay in the pay band will be stepped to such minimum.

For example, Letus take a person promoted from prerevised scale of 3050 to 4000, that is promoted from 1900 Grade pay to 2400 Grade pay. Both the scales in one Pay band of 5200-20200.

According to Revised Pay Rules, to add 3% of the increment with existing pay in the PB and it will be any chances suppose to come less than the 5200?

Pay in the PB is running pay band, so minimum of the higher PB is 7440 to taking place for promotion.

(1) The initial pay of a Government servant who elects, or is deemed to have elected under sub-rule (3) of rule 6 to be governed by the revised pay structure on and from the 1st day of January, 2006, shall, unless in any case the President by special order otherwise directs, be fixed separately in respect of his substantive pay in the permanent post on which he holds a lien or would have held a lien if it had not been suspended, and in respect of his pay in the officiating post held by him, in the following manner, namely :-
(A) in the case of all employees:-
(i) the pay in the pay band/pay scale will be determined by multiplying the existing basic pay as on 1.1.2006 by a factor of 1.86 and rounding off the resultant figure to the next multiple of 10.

( ii) if the minimum of the revised pay band/ pay scale is more than the amount arrived at as per (i) above, the pay shall be fixed at the minimum of the revised pay band/pay scale;

Provided further that:-
Where, in the fixation of pay, the pay of Government servants drawing pay at two or more consecutive stages in an existing scale gets bunched, that is to say, gets fixed in the revised pay structure at the same stage in the pay band, then, for every two stages so bunched, benefit of one increment shall be given so as to avoid bunching of more than two stages in the revised running pay bands. For this purpose, the increment will be calculated on the pay in the pay band. Grade pay would not be taken into account for the purpose of granting increments to alleviate bunching.
