Anomaly in annual increment arising due to the implementation of 6th Central Pay Commission Recommendations

The point regarding the anomaly relating to Rule 9 of the CCS (RP) Rules, 2008, concerning the date of next increment has been discussed in second Anomaly Committee meeting held on 27th March 2010. According to the Minutes of the meeting, Published by DOP&T on 4th May 2010, the Staff Side reiterated their demand that employees whose date of next increment falls between 1st February to 1st June may be given an increment, as a onetime measure, in the pre revised pay scales on 1.1.2006 as has already been done in respect of employees whose next date of increment was 1.1.2006.

The representatives of the Department of Expenditure stated that it is important to first examine the repercussions of granting an increment w.e.f 1. 1. 2006 in the pre revised pay scale because such a decision may eventually lead to certain other anomalies. After a long discussion, it was agreed that the Official Side would re- examine the matter and either suitable clarification in this regard will be issued before the next meeting of the National Anomaly Committee or if there is a need, the Department of Expenditure shall discuss the matter again with the representatives of the Staff Side.

But ,as agreed by the official side,the suitable clarification not been issued till now .

Dear Sir,
I like to invite government’s kind attention to the minutes of the second meeting of National Anomoly Committee held on 27th March,2010 and like to convey my sincere gratitude as an individual for the concern shown by Govt. representatives and representatives of Staff side in resolving the anomalies out of 6th CPC.

While discussing the Agenda No.5 (v), the representatives of the Govt. had expressed apprehension that granting an increment w.e.f. 01.01.2006 in pre-revised pay- scale to those employees whose date of next increment falls between 1st February to 1st June, as a one time measure may eventually lead to certain anomalies and therefore proposal had to be examined first. In this connection, I would like to submit that by all probabilities, it may not create anomaly because the seniors got this benefit by taking the increment on or before 01.01.2006. However more realistic approach could be to revise the pay on the date of increment / promotion between 01.02.2006 to 01.06.2006 and allow the next increment on 01.07.2006. In this case the employees may forego the arrears for the period from 01.01.2006 till revision of pay as they will draw pre-revised pay till then.

I hope the official side will come out with an appropriate solution to solve the anomaly. Needful to mention that my increment date was 01.02.2006 and retirement date falls on 31st March. The increment drawn for the period from 01.02.2006 to 30.06.2006, 01.02.2007 to 30.06.2007 and 01.02.2008 to 30.06.2008 in the pre-revised grade have been withdrawn and my arrears were very less than my juniors due to postponement of increment dates. Besides, it will effect my pensionary benefits because my retirement date falls on 31st March, whereas before 6th CPC, the increment date was 1st February i.e. before my retirement and my pension would have fixed after drawal of increment.

I hope, the Govt. will consider the issue sympathatically and issue necessary orders to settle the anomaly so that we are not put to regular financial loss, including pensionary benefits.

The Increment date is July 1st for all Central Government Employees



All employees who got their last increment between 2.1.2005 and 1.1.2006 would get their next increment on 1.7.2006. Those, whose date of increment falls on 1.1.2006, will draw increment in the pre-revised scale of pay on 1.1.2006 and the next increment on 1.7.2006 (as per O.M. dated 13 Sep, 2008).

Before 2006-Jan for those whose increment date were varied, after the implementation of VI CPC the announcement was made that for all, the increment date is July 1st which resulted in benefit to some and as a problem to others.

For some who got their increment between July and Dec 2005, the next increment then got was only on July 2006. That is they received their next increment within seven months, which was most beneficial to them.

For those who got their increment on Jan 2005, the next increment they received was only on July 2006. The span between one increment and the next ranged to 17 months resulting in a grave situation for them.

For receiving an increment instead of waiting for 12 months, we had to sit for 17 months thus resulting in a dire situation. So far there had been no salvation for those who experienced it.

Sum of Increment:-
For receiving one increment equal to 3% of the sum of the pay in the pay band and the existing grade pay will be computed and rounded off to the next multiple of 10. This will be added to the existing pay in the pay band.

Receiving two increments simultaneously:-
Eligible of receiving two increments simultaneously, those whose promotion ranges from January to June, accordingly to FR22(I)(a) (1) option would receive two increments on July 1st. (pay fixation on the date of next increment)

Taking together in to calculation both Promotional Increment and Annual Increment, two increments would be granted (as per O.M. dated 13 Sep, 2008). Even then while calculating of increment only the old Grade Pay in taken into consideration.

Leave on July first:-
If a government servant is on leave on the day of July first, the increased pay will be drawn only from the date on while he resumes duty and not from the first of July.

SUBJECT:     Grant of Variable Increment to high performers in the Pay Band 3- recommendation of the 6th Cpc



     The Sixth Central Pay Commission in Para 2.2.12 of its report, has recommended grant of higher rate of increment to not more than 20% of Group A officers in the Pay Band-3. As per the recommendations,for Group A officers in PB 3,annual increments in the band will vary depending upon the performance of the officer. The recommendations of the Pay Commission were considered and accepted with modification to the extent that Variable Increment may be granted @4% instead of 3.5% recommended by the Commission to not more than 20% High Performers in PB 3.

2.     All Ministries/Departments are requested to give their suggestions, before the guidelines for grant of Variable Increment are formulated & finalised by this Department. The suggestions should reach the undersigned within a month of the issue of this Office Memorandum failing which it will be presumed that the concerned Ministry/Department has no suggestion to make and this Department will proceed with the process of framing of guidelines in the matter.

Incentive increments to sportspersons for outstanding sports achievements National and International levels



Government have decided to grant incentive in the form of increments to such Government servants who achieve excellence in the sporting events of National / International importance.
It was also provided therein that the total number of increments to be awarded in achieving excellence in the National / International events should be laid down ata scale lower than the achieving excellence in international events and also that the total number of increments to be awarded to an individual should not exceed five in his/her entire career.

Subject: Date of next increment in cases where Government servants are not able join posts in a particular grade pay on promotion/appointment on 1st of January of a year due to Sunday or Gazetted Holiday – Clarification regarding.

As per the provisions of Rule 10 of CCS (RP) Rules, 2008, w.e.f. 1.1.2006, in the case of all Central Government employees there is a uniform date of increment, i.e. 1st July of every year.

Government servants completing six months and above in the revised pay structure as on 1st of July are eligible to be granted the increment. From the above provision of CCS (RP) Rules it flows that Government servants who have rendered less than 6 months of service as on 1st of July of a year will not be eligible to draw increment on that day and their date of increment will fall 12 months later on the next 1st of July.

Accordingly, all the Government servants who join posts in a particular grade on account of promotion / appointment etc., on 1st of January of a year will be eligible to draw their annual increment on the 1st of July of that year. However, those who join the posts between 2nd January and 30th June, will not be eligible for the same.
In the light of the above position, some administrative departments have sought clarification from this Department regarding date of next increment in cases where Government servants are not able join posts in a particular grade pay on promotion / appointment on 1st of January of a year due to 1st of January falling on a Sunday or Gazetted holiday.

In this connection, it is clarified that in the normal course, if a Government servant was to join post in a grade pay on appointment / promotion on 1st of January of the year happened to be a Sunday or Gazetted holiday, the Government servants who join posts on the 1st working day of the year will be treated to have completed 6 months of service on 1st of July of that year for the purpose of granting them annual increment on that day.

Subject:    Fixation of pay grant of increments in the revised pay structure - clarification regarding.

Following the notification of the CCS (Revised Pay) Rules, 2008, this Department has received references from some administrative departments, seeking clarification regarding various aspects of fixation of pay in the revised pay structure as also pay fixation and grant of increments in future under the revised pay sturctre. The matter has been considered in this Department. The points of doubt raised by administrative departments and the clarifications thereto are issued as under:-

1. As per the provisions of FR22(I)(a)(1), split option has to be submitted by the eligible employee (other than those appointed on deputation to ex-cadre post or adhoc basis or on direct recruitment basis) within one month of promotion. Some of the employees, promoted before 1.1.2006 as well as after 1.1.2006 but before notification of Revised Pay Rules, 2008 implementing 6th CPC recommendation, had opted for their pay fixation on promotion from the date of their next increment which was falling after 1.1.2006 in the 5th CPC scales as per the rules / pay structure then in force. Consequent. Upon implementation of recommendations of 6th CPC in August / Sept. 2008 effective from 1.1.2006, the option submitted by a number of employees has now turned to be disadvantageous. Whether such employees may be allowed to revise their options under FR22(I)(A)(1). DOP&T’s OM No.16/8/2000-Estt.(Pay-I) dt. 25.2.2003 provides that a Government Servant may give a revised option for pay fixation under FR 22 (I)(a)(1) within one month from the date of orders of such unforeseen developments or change of rules. In any such cases, that have resulted form the notification of CCS (Revised Pay) Rules, 2008, Government Servants may be allowed to exercise a revised option for fixation of their pay in the promotion post within one month from the date of issue of these clarifications, if they have already not been allowed to do so under DOPT’s O.M. dated 25.2.2003 mentioned above.
2. As per Rule 5 of the Central Civil Services(Revised Pay) Rules 2008, a Govt. servant placed in a higher pay scale between 1.1.2006 and the date of notification of these rules on account of promotion, upgradation of pay scales etc. can elect to switch over to the revised pay structure from the date of such promotion (i.e. after placement in the promotional grade), upgradation etc. The employees promoted or upgraded to higher grade have option to have their pay fixed/re-fixed as per the provisions of FR 22/ FR 23 from the date of next increment etc. Whether such employees covered by Rule 5 of CCS(RP) Rules, 2008 can also revise their options now to choose either from the date of promotion/upgradation or the date of increment etc. (which may fall on the 1st July 2006,2007,2008 or 2009 etc.), as annual increment in the new structure is given uniformly on 1st July? Whether such option will also be available in the cases of ad-hoc promotions(whether or not followed by regularization without break) Proviso to Rule 5 of CCS (RP) Rules, 2008 states that a Government servant may elect to continue to draw pay in the existing scale until the date on which he earns his next or any subsequent increment in the existing scale, or until he vacates his post, or ceases to draw pay in that scale. The Rule ibid further provides that in cases where a Government servant has been placed in a higher pay scale between 1.1.2006 and the date of notification of these Rules on account or promotion, upgradation of pay scale etc., the Government servant may elect to switch over to the revised pay structure from the date of such promotion, upgradation, etc. It is clarified that such cases will be regulated under proviso to Rule 5 of the CCS (Revised Pay) Rules, 2008. After switching over to the revised pqy structure, Clarification 2 (the method of fixation of pay on promotion after 1.1.2006) issued vide O.M. No. 1/1/2008-IC dated 13.9.2008 will apply. In the case of ad-hoc promotions granted between 1.1.2006 and date of notification of CCS (RP) Rules, 2008, a Government Servant has the option to have his pay fixed under proviso to Rule 5. However, Clarification 2 (the method of fixation of pay on promotion after 1.1.2006) issued vide O.M. No.1/1/2008-IC dated 13.9.2008 will not apply in such cases.
3. As per Rule 13 (i) of CCS(RP) Rules, 2008, in the case of promotion from one grade pay to another and that involving change of pay band, one increment equal to 3% of basic may be allowed and in addition higher grade pay of the promotional post may also be allowed. As per clarification 2 of MOF OM No. 1/1/2008-IC dated 13-09-2008, on promotion from one grade to another, a Govt. servant has an option under FR22(I)(a)(1) to get his pay fixed in the higher post either from the date of his promotion, or from date of his next increment. As per the provisions of FR22(I)(a)(1), the benefit of fixation under above rule is admissible only in cases of appointment involving duties & responsibilities of greater importance. Further, the grant of option under above FR is also subject to the condition that the appointment is not on deputation on ex-cadre. basis / ad-hoc or direct recruitment basis. It is not clear whether: (a) FR 22(I)(a)(1) still holds good in its present form with all the attendant comditions; or (b) The same has got modified on introduction of Sixth CPC Pay structure; and if yes (c) What is the extent of modification to above FR. Point No.(a): FR22(I)(a)(1) still holds good. Points No.(b) & (c): Clarification No.2 of this Department’s O.M.No.1/1/2008-IC date 13th September, 2008 prescribes the method of fixation of pay under FR22(I)(a)(1) after introduction of pay bands and grade pay.
4. Methodology for rounding off: As per Rule 9 of the notification, the rate of increment in the revised pay structure will be 3% of the sum of the pay in the pay band and grade pay applicable, which will be rounded off to the next multiple of 10. Whether rounding off to next multiple of 10 has to be done in terms of rupees or even a paisa has to be rounded off to next multiple of 10. For example, if the pay after drawl of increment works out to Rs.10510.10 the same has to be rounded off to 10520 or 10510. In the case Fitment Tables annexed with this Department’s OM of even number dated 30.08.2008, riybdubg off has already been done and the same should be implemented without any modification. In the case of calculation of increments under the revised pay structure, paise should be ignored, but any amount of a rupee or more should be rounded off to next multiple of 10. To illustrate, if the amount of increment comes to Rs. 1900.70 paise, then the amount will be rounded off to Rs.1900; if the amount of increment works out to be Rs.1901,d then it will be rounded off to Rs.1910.
5.Grant of stagnation increment:Whether the employees who have been grant3d stagnation increment between February 2005 or thereafter are to be granted additional increment w.e.f 1.1.2006,while fixing the pay or not? Since they have reached a the maximum of the existing pay scale. In all cases, where a Government servant has been ranted an increment (whether normal annual increment or stagnation increment) after January 1, 2005, no increment will be allowed on 1.1.2006 at the time of fixation of pay in the revised pay structure.

HINDI VERSION STANDS REJECTED - ENGLISH VERSION REIETERATED BY MOF

CONFEDERATION CHARTER OF DEMANDS WILL INSIST INCREMENT DATE

Today The MOF issued a clarificatory order on date of increment, method of fixation of pay on promotion after 1.1.2006, Use of fitment table for cases fixex under Rule 11, Fixation of pay for those on deputation etc.

Accordingly the date of increment will be only 1st July every year. For Officials who have been in the Revised Pay Structure for six months from 1.1.2006 to 1.7.2006 for six months are eligible for increment on 1.7.2006. It is clarified clearly that those who have drawn their earlier incerment between 2.1.2005 and 1.1.2006 would be given their next increment on 1.7.2006. Those officials whose date of increment is 1.1.2006, they would be given increment in old scale before fixation in Revised Pay and then again on 1.7.2006 another increment in the Revised Pay.

However this clarification is not totally satisfactory to us. The increment of those officials fallilng between 2.1.2006 and 30.06.2006 is getting postponed. The increment of other officials falling between 1.8.2006 and 31.12.2006 is getting advanced. From the Confederation it has been decided to insist for the demand already placed before the Cabinet Secretary so that all officials get their increment in Revised Pay on 1st January instead of 1st July. This will eliminate postponing of increment for some officials while preponing for some others. The Revised Charter of Demands under preparation will be exhibited in the Confederation Website shortly will contain this demand also for our 19th September 2008 programme of 'Strike Declaration Day'.

Another Clarification for the officials on promotion who opt for fitment in Revised Pay Structure from the date of their next increment, the clarification of MOF is that on the day of promotion the official will get the same pay in his pay band but the grade pay of his promotional level will be granted and the further re-fixation would be done on the day of his new increment viz, 1st July when he would get two increments - one annual increment and the other the promotional increment.

There are other clarifications also about officials who opt for revised pay from the date of their promotion; Fitment under Rule 11 of CCS[RP]Rules 2008, Fixation for officials on deputation, Procedure to be adopted for placing the officials in cases of merger of scales / upgradations recommended by the 6th CPC.

As for as the merger of scales / upgradations are concerned, it is clarified that in cases where all posts in one cade or more in pre-revised scales are merged with a higher pre-revised scale of pay the officials would be granted the replacement pay scale/Grade Pay. In cases where all posts in particular cadre have been granted a higher replacement scale then the officials would be fixed in their pre-revised pay scale with the Grade Pay of the higher replacement scale.

WHEN WILL BE THE DATE OF NEXT INCREMENT

SOME DDOs WRONGLY DO NOT DRAW INCREMENT ON 1.7.2006

Annual Increment should be drawn on 1.7.2006 if the official's pay fixed in Revised Pay Structure on 1.1.2006 as per Para 10 of CCS [RP] Rules, 2008.

Majority of DDOs correctly apply the Para 10 of the CCS [RP] Rules, 2008 and draw increment in revised pay on 1.7.2006 for all those employees those who have been placed in the Revised 6th CPC Pay Structure w.e.f. 1.1.2006 by virtue of their remaining under the Revised Pay Structure for 6 months.

However, there are reports that some DDOs are not doing so and not drawing the annual increment on 1.7.2006 but only drawing it on 1.7.2007 for those employees whose existing date of increment is between 1st January 2006 and 1st June 2006. This is wrong.

Kindly refer to CCS [RP] Rules, 2008 under Para Numbered 10 on 'Date of next increment in the revised pay structure' – wherein it is stipulated that:

"There will be a uniform date of annual increment. Viz, 1st July of every year. Employees completing 6 months and above in the revised pay structure as on 1st of July will be eligible to be granted the increment. The first increment after fixation of pay on 1.1.2006 in the revised pay structure will be granted on 1.7.2006 for those employees for whom the date of next increment was between 1st July, 2006 to 1st January, 2007."

The above Para 10 has got three parts.

1. There will be a uniform date of annual increment viz, 1st July of every year.

2. Exployees completing 6 months and above in the revised pay structure as on 1st July will be eligible to be granted the increment.

3. The first increment after fixation of pay on 1.1.2006 in the revised pay structure will be granted on 1.7.2006 for those employees [also] for whom the date of next increment was between 1st July 2006 to 1st January 2007.

NOW LET US ANALYSE THE WHOLE PARA:

Employees completing 6 months and above in the revised pay structure as on 1st of July will be eligible to be granted the increment – This means that all employees who were placed in the revised pay structure on 1.1.2006 and will be completing 6 months service in the revised pay structure as on 1st July 2006 are eligible for an increment on 1.7.2006.

BASED ON THIS LINE OF THE ORDER ALL EMPLOYEES ARE ELIGIBLE TO GET NEXT INCREMENT ON 1.7.2006 IN THE REVISED PAY.

The next sentence of the Para 10 viz," The first increment after fixation of pay on 1.1.2006 in the revised pay structure will be granted on 1.7.2006 for those employees for whom the date of next increment was between 1st July, 2006 to 1st January, 2007." – means those employees whose increment date is on or after 1st July also should be given the increment from 1.7.2006 itself.

Therefore the first line of Para 10 of the Government Order which says "There will be a uniform date of annual increment. Viz, 1st July of every year" will be thus correctly implemented if the increment is drawn to officials whose increment date presently on or after 1st July 2006 and also before 1st July 2006 provided the official's pay is fixed in Revised Pay Structure from 1.1.2006. The main point is that without being in the Revised Pay Struture no official can draw his new increment in the Revised pay structure. This is the main contention of the order.

There are some DDOs who are confused with linking the two sentences in Para 10 and refusing to grant the increment on 1.7.2006 but giving increment only on 1.7.2007 for those employees whose increment falls between 1st January to 1st June of 2006, thus causing postponement of grant of increment beyond 2 years. This is wrong. This will in effect even deny the benefit of increment for officials who are about to retire before 1.7.2007 and cause heavy pension loss too. More over this is not the intention of the order also. Only a wrong understanding of the Para 10 by these DDOs causes such a problem. Please approach these DDOs with this interpretation and cause correct application.

There will be a uniform date of annual increment, viz. 1st July of every year. Employees completing 6 months and above in the revised pay structure as on 1st of July will be eligible to be granted the increment. The first increment after fixation of pay on 1.1.2006 in the revised pay structure will be granted on 1.7.2006 for those employees for whom the date of next increment was between 1st July, 2006 to 1stst January, 2007.

Provided that in the case of persons who had been drawing maximum of the existing scale for more than a year as on the 1st day of January, 2006, the next increment in the revised pay structure shall be allowed on the 1st day of January, 2006. Thereafter, the provision of Rule 10 would apply.

Provided that in cases where an employee reaches the maximum of his pay band, shall be placed in the next higher pay band after one year of reaching such a maximum. At the time of placement in the higher pay band, benefit of one increment will be provided. Thereafter, he will continue to move in the higher pay band till his pay in the pay band reaches the maximum of PB-4, after which no further increments will be granted.

Note 1 - In cases where two existing scales, one being a promotional scale for the other, are merged, and the junior Government servant, now drawing his pay at equal or lower stage in the lower scale of pay, happens to draw more pay in the pay band in the revised pay structure than the pay of the senior Government servant in the existing higher scale, the pay in the pay band of the senior government servant shall be stepped up to that of his junior from the same date
