Stepping up of pay of senior Assistants/PAs Central Secretariat Service (CSS)/Central Secretariat Stenographers' Service (CSSS)

Subject:

Stepping up of pay of senior Assistants/ PAs of CSS/CSSS promoted prior to 01.01.2006 & Drawing less pay than assistants/PAs of CSS/CSSS promoted after 01.01.2006.


         A large number of references were received from various Ministries/Departments and service Associations regarding stepping up of pay of senior Assistants/PAs Central Secretariat Service (CSS)/Central Secretariat Stenographers' Service (CSSS) promoted prior to 01.01.2006 and drawing less pay than Assistants/PAs of CSS/CSSS promoted after 01.01.2006.

2.       The matter has been examined in consultation with Ministry of Finance. The Department of Expenditure vide UO No. 10/1/2009-IC dated 14.12.2009 (copy enclosed) had issued a clarification regarding manner in which pay of Assistants/PAs would be fixed consequent upon grant of revised pay structure of Grade Pay of Rs. 4600 in the pay band PB-2 to them on the basis of OM dated 16.11.2009.

3.       In this context, it is clarified that benefit of stepping up of pay as per Note 10 under Rule 7 of CCS(RP) Rules 2008 would be admissible to senior Assistants/PAs of CSS/CSSS promoted prior to 01.01.2006 and drawing less pay than Assistants/PAs of CSS/CSSS promoted after 01.01.2006.

4.       All Ministries/Departments may regulate stepping up cases of Assistants/PAs of CSS/CSSS accordingly.

Subject: Promotion of Assistant to the grade of Section Officer of Central Secretariat Service (CSS) on ad-hoc basis.

The undersigned is directed to refer to this Department's OMs No.6/5/2010-CS-I(S) dated 30.08.2010 and 04.11.2010 on the subject mentioned above.

2. Considering the fact that posts are lying vacant in the Section Officers’ Grade in various Ministries/Departments mainly on account of litigation, it has been decided that eligible Assistants (who have completed 8 years of approved service in the grade of Assistant) upto SCSLs 1999 (General Category), upto SCSLs 2000 (SC Category) and upto SCSLs 2002 (ST Category) may be promoted to the grade of Section Officer on ad-hoc basis to the extent of vacant posts available in the Cadre Units upto 01.12.2010. The ad-hoc promotion/appointment would be subject to the following conditions:-

(i) The period of ad-hoc promotion would be upto 31.03.2011 or till the regular Section Officers are made available, whichever is earlier;

(ii) The ad-hoc appointments shall not confer on the appointees any right to continue in the grade indefinitely or for inclusion in the Select List of Section Officers for regular appointment cr to claim seniority in the Section Officers grade of CSS;

(iii) Ad-hoc appointments would continue till regular candidates in Section Officer Grade are available either through Seniority Quota or Limited Departmental Competitive Examination (LDCE). In the event of the ad-hoc appointees not qualifying for regular appointment in either of these two categories, they will be reverted to the Assistants’ Grade on availability of such regular officers from the date they (regular Section Officers) join duty in their respective cadre units allotted to them by this Department;

(iv) The effective date of ad-hoc promotion in respect of those found fit and clear from vigilance angle would be the date from which the officer concerned joins duty in Section Officers’ grade in his own cadre unit.

3. If any of the Officers, who is eligible for promotion in Section Officer grade on ad-hoc basis and is on deputation, he/she may be given option to revert within one month with a view to avail of the promotion on ad-hoc basis

4. All the Cadre Units are requested to take urgent action to conduct DPCs in respect of all the Assistants within the Zone prescribed as at Para 2 above and to promote eligible Assistants to the grade of Section Officer on ad-hoc basis to the extent of vacancies available upto 1st December, 2010. A copy of the appointment order may be endorsed to this Department.

5. The recommendations of the DPC in respect of the remaining eligible Assistants in the above zone, who are clear from vigilance angle and cannot be promoted by 01.12.2010 within the Cadre Unit due to lack of vacancies, may be forwarded to this Division immediately,

latest 01.12.2010

by so that they could be promoted against existing vacancies in SO grade elsewhere,as indicated in this Department’s OM NO 6/5/2010-CS-I(S) dated 04.11.2010.

6. It has also been decided that the period of promotion allowed upto 31.12.2010,in the case of existing ad-hoc section officers may be extended upto 31.03.2011 subject to the conditions as prescribed in para 2 above of this OM

7. After the completion of the process as indicated in Para 4 & 5 above, all the Cadre Units are requested to convey the following information immediately latest by 01.12.2010:

i) The details of the Assistants promoted on ad-hoc basis in SO grade after the issue of this order (Annexure- I).

ii) DPC recommendations in respect of the remaining eligible Assistants in the zone prescribed as indicated in Para 5 above (Annexure-II).

iii) The details of the eligible Assistants in SCSLs 2000 to 2002(Gen.) and SCSLs 2001 to 2002(SC) (Annexure­-III).

Calculation of resultant vacancies in the grade of UDCs of CSCS

Subject:    Calculation of resultant vacancies in the grade of UDCs of CSCS consequent upon promotion of 2151 UDC to Assistant for the List Year 2003 - Reg.



            All the cadre units participating in CSS and CSCS are aware that consequent upon restructuring of CSS in 2003, 2151 posts in the grade of Assistants were made available which were filled up by promotion of regular UDCs from Select List Year 1987 (part) upto 1992 vide this Departments O.M. 7/3/2003-CS-II dated 14/7/2009 on as is where is basis. As a natural corollary to that equal number of vacancies should have been made available in the grade of UDC. However, the same have not been intimated by the cadre units.

Since the regular panels in the grade of UDC for SL year 2003 onwards upto 2006 had already been finalised by this Department (before the extended list of Assistant, promoting 2151 UDCs, was issued), the resultant vacancies in the grade of UDC could not be immediately assessed and made available further down below in the hierarchy. A need has, therefore, arisen to reassess the vacancies in the grade of UDC for the Select List year 2003 onwards.

In view of the above, it is possible that the vacancies arising out of the promotion of large number of UDCs as Assistant have not been reported, as the regular panels in the grade of UDC for SL year 2003 onwards upto 2006 had already been finalised by this Department. All the cadre units are, therefore, requested to intimate the number of regular vacancies reported and filled up in the grade of UDC from SL Y 2003 onwards and also to re-assess the vacancies in the grade of UDC taking into account the promotion of 2151 UDCs to the grade of Assistant for the select list year 2003 onwards as per Proforma annexed. The information in the prescribed proforma may positively be sent to this Department latest by 30/09/2010.

The undersigned is directed to refer to this Department’s OM of even number dated 7.6.2010 on the subject mentioned above.

2. Considering the fact that posts are lying vacant in the Section Officers' Grade in various Ministries/Departments mainly on account of litigation, it has been decided that eligible Assistants of SCSLs 1998 (General Category), upto SCSLs 1999 (SC Category) and upto SCSLs 2001 (ST Category) may be promoted to the grade of Section Officer on ad-hoc basis to the extent of vacant posts (including the posts falling vacant due to retirement upto 31.12.2010) available in the Cadre Units. The ad-hoc promotion/appointment would be subject to the following conditions:

(i) The period of ad-hoc promotion would be upto 31.12.2010 or till the regular Section Officers are made available, whichever is earlier;

Vital changes in the pay structure of the Railway employees



Shiva Gopal Mishra General Secretary of AIRMF addressed a press conference on 25.06.10 at Press Club of India, New Delhi. He touched various burning issues in Indian Railways. We reproduce full text of the letter as follows...

PRESS RELEASE

New Delhi, June 25, 2010, “There will be vital changes in the pay structure of the Railway employees”, this was stated by Shri Shiva Gopal Mishra, General Secretary, All India Railwaymen's Federation and Northern Railwaymen’s Union in a Press Conference held here in Press Club.

Shri Mishra stated that, keeping in view the interests of the Railwaymen working in various categories; Railway Board has given its consent to change their Pay Bands widely. He stated that, after the meeting of Departmental Anomaly Committee, it was recommended to provide GP Rs.4800 to all Supervisors of apex grade as well as modification in other cadres have also been suggested.

Shri Mishra stated that more than one lakh Technicians, working in the Indian Railways and used to call Technician-II with GP Rs.2400, will now be merged with Technician-I GP Rs.2800. This will also be applicable on more than 36,000 Ticket Collectors in GP Rs.2400 and they will be provided with GP Rs.2800.

Shri Mishra informed that the Railway Board has also recommended to improve the grade pay of Technical Supervisor, Section Engineer, Jr. Engineer from GP Rs.4200 and 4600 to Rs.4600 and 4800 respectively.

“Railway Board have also recommended grade pay of Loco Pilot and Guard; and based on this, Loco Pilots of Mail and Express trains will be provided with GP Rs.4600. Besides this, Railway Board have also recommended to give Additional Allowance to the Loco Pilot(Goods) and Guard(Goods)”, Shri Mishra informed.

Shri Mishra stated that, keeping in view recruitment qualification(Graduation) and special working conditions of the Asstt. Station Master, Railway Board have recommended to provide them Entry GP Rs.4200.

Shri Mishra further stated that the main reasons of all these improvements were better coordination between AIRF and Hon’ble MR and Railway Board and also pressure of the MR on the Railway Board. Shri Mishra informed that all these recommendations have been sent to Ministry of Finance by the Railway Ministry.

“Hon’ble MR has given assurance that every possible efforts will be done to resolve the problems of the Railwaymen”, Shri Mishra informed.

“I had also raised the issue of payment of arrears to Loco Pilot and Guards w.e.f. 1.1.2006 and KMA before Hon’ble MR, which has been rejected by the Fast Track Committee. She has assured that it will be looked into”, Shri Mishra stated.

Shri Mishra also informed that the Railway Board has decided to constitute a committee to improve pay scales of more 2.5 lakh Gangmen, Keymen, Mate, Gatemen working on the Indian Railways and also to provide them Special Package. Shri Mishra further added that this category is unique, which used to be recruited and retired in GP Rs.1800.

Shri Mishra stated that he had raised the issue of filling-up of around two lakh vacant posts without further delay. Hon’ble MR has given him assurance; and some action has also been taken to overcome this problem.

Shri Mishra informed that I had also raised the issue of entitlement of Privilege Pass before the Hon’ble MR and she has assured for its early finalization.

CAT rejects plea of R&AW officer seeking promotion

The Central Administrative Tribunal has turned down a plea for promotion of a Research and Analysis Wing (R&AW) officer, saying he was not subjected to any discrimination with regard to service gradings.

R&AW Additional Secretary C K Sinha approached the Tribunal seeking directions to the Centre to promote him to Special Secretary, contending that authorities treated him unfairly in awarding downgradings in ACRs.

The Tribunal said the departmental promotions committee (DPC) after considering his candidature found him unfit for the post as his annual confidential reports (ACRs) were below the bench mark.

"We have carefully perused the ACRs of Sinha. In so far as the ACR for the period 1998-99 is concerned, the accepting authority has recorded the reasons for downgrading....

Subject: Below Benchmark gradings in ACRs prior to the reporting period 2008-09 and objective consideration of representation by the competent authority against remarks in the APAR or for upgradatin of the final grading.



  

The undersigned is directed to say that prior to the reporting period 2008-09, only the adverse remarks in the ACRs had to be communicated to the concerned officer for representation, if any to be considered by the competent authority. The question of treating the grading in the ACR which is below the benchmark for next promotion has been considered in this Deparment and it has been decided that if an employee is to be considered for promotion in a future DPC and his ACRs prior to the period 2008-09 which would be reckonable for assessment of his fitness in such future DPCs contain final grading which are below the benchmark for his next promotion, before such ACRs are placed before the DPC,the concemed employee will be given a copy of the relevant ACR for his representation, if any, within 15 days of such communication. It may be noted that only below benchmark ACR for the period relevant to promotion need be sent. There is no need to send below benchmark ACRs of other years.



  

2. As per existing instructions, representations against the remarks or for upgradation of !he final grading given in the APAR (previously known as ACR) should be examined by the competent authority in consultation, if necessary, with the Reporting and the Reviewing Officer, if any. While considering the representation, the competent authority decides the matter objectively in a quasi-judicial manner on the basis of material placed before it. This would imply that the competent authority shall take into account the contentions of the officer who has represented against the particular remarks/grading in the APAR and the views of the Reporting and Reviewing officer if they are still in service on the points raised in the representation vis-a-vis the remarks/gradings given bv them in the APAR. The UPSC has informed this Departrnent that the Commission has observed that while deciding such representations, the competent authorities sometimes do not take into account the views of Reporting/Reviewing Officers if thev are still in service. The Commission has further observed that in majority of such cases, the competent authority does not give specific reasons for upgrading the below benchmark ACR/APAR gradings at par with the benchmark for next promotion.

  

3.All Ministries/Departments are therefore requested to inform the competent authorities while forwarding such cases to them to decide on the representations against the remarks or for upgradation of the grading in the APAR that the decision on the representation may be taken objectively after taking into account the views of the concerned Reporting/Reviewing Officers if they are still in service' and in case of upgradation of the final grading given in the APAR, specific reasons therefor may also be given in the order of the competent authority.

'Govt employee has fundamental right to be considered for promotion'

The Supreme Court has ruled that a Government employee has a fundamental right to be considered for promotion and it is mandatory for the Centre and States to carry out cadre review of eligible officers for promotion to the Indian Administrative Service (IAS).

"The right of eligible employees to be considered for promotion is virtually a part of their fundamental right guaranteed under Article 16(Equality of opportunity in matter of public employment) of the Constitution," a bench comprising Justices R V Raveendran and A K Ganguly held in a recent judgement.

The apex court passed the judgement while directing the Centre and the UP Government to consider the promotion of two State cadre officers-Hemraj Singh Chauhan and Ramnawal Singh to the IAS.

"We hold that the statutory duty which is cast on the State Government and the Central Government to undertake the cadre review exercise every five years is ordinarily mandatory subject to exceptions which may be justified in the facts of a given case," the bench said.

Implementation of the All India Services (Performance Appraisal Report) Rules, 2007

Subject:- The All India Services (Performance Appraisal Report) Rules, 2007 - Instructions regarding numerical grading.


Sir / Madam,
With the implementation of the All India Services (Performance Appraisal Report) Rules, 2007, the conventional gradings awarded to the members of the All India Services in the old All India Services (Confidential Roll) Rules, 1970 has been changed to numerical gradings in a scale of 1 to 10, where 1 refers to the lowest grade and 10 to the highest. The Government of India instructions issued on 18 th July, 2008 envisages that high credit should not be given to the members of the Service in a routine manner by the Reporting/Reviewing Authorities and this should be restricted to 20% of the officers under their supervision. Further, the Government of India instruction issued on 3 rd December, 2008 provides that any grading of more than 8 for each attribute must be justified by giving reasons in writing in a separate sheet.

2. For the adoption of the new system of Performance Appraisal, it hasbeen observed that in the absence of commonly understood benchmark, thereis wide disparity in awarding numerical grading amongst reporting authorities.In order to bring about uniformity in the interpretation of numerical grades,the following guidelines are issued which Reporting Authorities may keep in mind while awarding numerical gradings:

i. Members of the Service graded between 8 and 10 will be rated as 'outstanding' and will be given a score of 9 for the purpose of calculating average scores for empanelment/promotion.

ii. Members of the Service graded between 6 and short of 8 will be rated as 'very good' and will be given a score of 7.

iii. Members of the Service graded between 4 and 6 short of 6 will be rated as 'good' and given a score of 5.

iv. Members of the Service graded below 4 will be given a score of zero.

3. Assessment of numerical grading in the above manner will be done forthe purpose of promotion/empanelment and for utilizing PARdocument for any purpose pertaining to personnel management.

4. These instructions may be brought to the notice of all the All India Service Officers working under your charge.

Subject : Sixth Central Pay Commission's recommendations - revision of pay scales - amendment of Service Rules / Recruitment Rules The recommendations of 6th CPC have been considered by the Government and the CCS (Revised Pay) Rules2008 have since been notified on 29th August, 2008. Consequently, in palce of the pre-revised pay scales, the revised pay structure comprising the Pay Band and Grade Pay / Pay Scales has come into effect. Some of thepre-revised pay scales have been merged and some others are upgraded / likely to be upgraded. In the light of these, it has been decided that the following consequential steps to amend the existing Service Rules / Recruitment Rules shall be undertaken on a priority basis:
(i) Substituting the existing scales by the Grade Pay along with the Pay Band
The existing pay scales have to be substituted by the new pay structure (Pay Band and Grade Pay / Pay Scale)straightaway without making a reference to the Department of Personnel and Training (DOP&T) / Union Public Service Commission (UPSC). The heading of column No. 4 of the Schedule on RRs may be modified to :Pay Bandand Grade Pay / Pay Scale". In cases where deputation is also one of the methods of recruitment, the field of selectionfor deputation, which might include various grades, should also reflect the corresponding Grade Pay alongwith the Pay Band / Pay Scale, and the minimum eligibility service as per the revised guidelines, as enclosed in Annexure.
(ii) Where there is an upgradation of posts
The instructions issued by Department of Expenditure under OM No. 1/1/2008-iC dated 13 th September, 208 and DoPT OM No. AB- 14017/66/08-Estt (RR) dated 9th March, 2009 may be applied in such cases.
However, for each of the merged grades, a single set of Recruitment Rules may be formulated and notified.
(iii) Consequential cahanges
It is necessary to make consequential changes in the Recruitment Rules / Service Rules so as to prescribe eligibilityconditions with reference to the revised Grade Pay / Pay Scale. It is also necessary to review other columns of theRecruitment Rules / Service Rules, where some minimum service in a particular scale / grade is prescribed for consideration for appointment on deputation / absorption etc., keeping in view particularly the merger of a number of pre-revised scales, upgradation of some scales and the consequential changes in the minimum eligibility service in a grade.
(iv) Department Promotion Committee (DPC)
Where two or more scales have been merged, the existing DPC for the higher / highest grade will be the DPC for the mergedgrade.
(v) Regulation of regular rendered in the pre-revised scales
The revised pay structure approved includes a number of 'merged grades' with a commn grade pay and the conceptof pay bands with grade pay introduced effective from 1.1.2006. Insofar as the issue of regulation of service rendered prior to 1.1.2006 is concerned, while the general rule may be that such regular service be deemed to be service renderedin the corresponding grade pay / pay scale approved effective from 1.1.2006 or from a subsequent date, as the case maybe, this formulation cannot apply in cases where there has been merger of more than one grade into one with a single gradepay/ pay scale. Since the merger is effective from 1.1.2006 only, even notional benefits of the merger cannot be extended forperiods falling prior to 1.1.2006. A Note to the following effect may, therefore, be inserted under col.12 of the Schedule on RRs, and under relevant provisions in Service Rules, to take care of the requirements:
Note:
For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1.1.2006 / the date from which the revised pay structure based on the 6th CPC recommendations has beenextended, shall be deemed to be service rendered in the corresponding grade pay / pay scale extended based on the recommendations of the Commission. For purposes of appointment on deputation / absorption basis, the service renderedon a regular basis by an officer prior to 1.1.2006 / the date from which the revised pay structure based on the 6th CPCrecommendations has been extended, shall be deemed tobe service rendered in the corresponding grade pay / pay scaleextended based on the recommendations of the Commission except where there has been merger of more than one pre-revisedscale of pay into one grade with a common grade pay / pay scale, and where this benefit will extend only for the post(s) for whichthat grade pay / pay scale is the normal replacement grade without any upgradation.
2. The Recruitment Rules / Service Rules are of statutory nature. Therefore, the changes brought out by other relevantinstructions have to be incorprated in the Recruitment Rules / Service Rules by suitable amendments so that the necessarysteps like holding of DPC etc. are taken to fill the post carrying the revised Grade Pay / Pay Scale on regular basis. All the Ministries / Departments are, therefore, requested to effect necessary amendments to the Recruitment Rules / Service Rulesnotified by them after following the normal procedure of furnishing proposals to the Department of Personnel and Training andthe UPSC in the format prescribed in the general guidelines on Recruitment Rules circulated by the DOPT OM No. 14017/12/87-Estt.(RR) datded 18.3.1988, and also in consultation with the Legislative Department.
3. Ministries/Departments may initiate action to complete the review in this regard and furnish necessary amendment proposals to the DOPT and the UPSC in the case of Group A and Group B posts within six months from the date of issue of this Office Memorandum. They may also, simultaneously, take similar action in respect of Recruitment Rules for Group C and D posts, which are within their delegated powers. Appropriate action to update the Service Ruels for organized Group A, B Services,etc. shall also be taken up with DOPT / UPSC within a peroid of Six Months.

Subject: Date of next increment in cases where Government servants are not able join posts in a particular grade pay on promotion/appointment on 1st of January of a year due to Sunday or Gazetted Holiday – Clarification regarding.

As per the provisions of Rule 10 of CCS (RP) Rules, 2008, w.e.f. 1.1.2006, in the case of all Central Government employees there is a uniform date of increment, i.e. 1st July of every year.

Government servants completing six months and above in the revised pay structure as on 1st of July are eligible to be granted the increment. From the above provision of CCS (RP) Rules it flows that Government servants who have rendered less than 6 months of service as on 1st of July of a year will not be eligible to draw increment on that day and their date of increment will fall 12 months later on the next 1st of July.

Accordingly, all the Government servants who join posts in a particular grade on account of promotion / appointment etc., on 1st of January of a year will be eligible to draw their annual increment on the 1st of July of that year. However, those who join the posts between 2nd January and 30th June, will not be eligible for the same.
In the light of the above position, some administrative departments have sought clarification from this Department regarding date of next increment in cases where Government servants are not able join posts in a particular grade pay on promotion / appointment on 1st of January of a year due to 1st of January falling on a Sunday or Gazetted holiday.

In this connection, it is clarified that in the normal course, if a Government servant was to join post in a grade pay on appointment / promotion on 1st of January of the year happened to be a Sunday or Gazetted holiday, the Government servants who join posts on the 1st working day of the year will be treated to have completed 6 months of service on 1st of July of that year for the purpose of granting them annual increment on that day.

Departmental Promotion Committee (DPC)
The regular promotions of the government employees are generally decided on the basis of recommendations made by the Departmental Promotion Committees. The Departmental Promotion Committees are constituted to judge the suitability of officers for -
(a) promotions to “Selection” as well as "Non-selection" posts
(b) assessment of the work and conduct of probationers for the purpose of determining their suitability for retention in service or their discharge from it or extending their probation and subsequent confirmation if found suitable for retention in service.

The UPSC should be associated with DPCs in respect of all Central Civil Services/posts belonging to Group 'A' where promotion is based on the principles of “Selection cum Seniority” unless it has been decided by the Government not to associate the UPSC with a Group 'A' DPC. The UPSC need not be associated in respect of the posts belonging to Group 'A', if the promotion is based not on the principles of "Selection" but on “seniority-cum-fitness” only.

Whenever the UPSC is associated with a DPC, the Chairman or a Member of the Commission will preside over the meeting of the DPC.
Where the Recruitment/Service Rules lay down promotion as one of the methods of recruitment, some period of service in the feeder grade is generally prescribed as one of the conditions of eligibility for the purpose of promotion.
The eligibility dates for determining the eligibility of officers for promotion would be the first day of the crucial year, i.e. January, 1 irrespective of whether ACRs are written financial year-wise or calendar year-wise.

Guidelines for DPCs
The following guidelines are laid down to regulate the assessment of suitability of candidates by DPCs:
While merit has to be recognised and rewarded, advancement in an officer's career should not be regarded as a matter of course, but should be earned by dint of hard work, good conduct and result-oriented performance as reflected in the annual confidential reports and based on strict and rigorous selection process.
Confidential Reports are the basic inputs on the basis of which assessment is to be made by each DPC. The evaluation of CRs should be fair, just and non-discriminatory. Hence, the DPC should assess the suitability of the employees for promotion on the basis of their Service Records and with particular reference to the CRs for five preceding years irrespective of the qualifying service prescribed in the Service/Recruitment Rules. (If more than one CR has been written for a particular year, all the CRs for the relevant years shall be considered together as the CR for one year).
Where one or more CRs have not been written for any reason during the relevant period, the DPC should consider the CRs of the years preceding the period in question and if in any case even these are not available, the DPC should take the CRs of the lower grade into account to complete the number of CRs required to be considered as per above para. If this is also not possible, all the available CRs should be taken into account.

Principles to be observed for preparation of panel:
In case of ‘selection’ (merit) promotion, the hitherto existing distinction in the nomenclature (‘selected by merit’ and ‘selection-cum-seniority) is dispensed with and the mode of promotion in all such cases is rechristened as ‘selection’ only. The element of selectivity (higher or lower) shall be determined with reference to the relevant benchmark (“Very Good” or “Good”) prescribed for promotion.

The DPC shall determine the merit of those being assessed for promotion with reference to the prescribed benchmark and accordingly grade the officers as ‘fit’ or ‘unfit’ only. Only those who are graded ‘fit’ (i.e. who meet the prescribed benchmark) by the DPC shall be included and arranged in the select panel in order of their inter-se seniority in the feeder grade.

Those officers who are graded ‘unfit’ (in terms of the prescribed benchmark) by the DPC shall not be included in the select panel. Thus, there shall be no supersession in promotion among those who are graded ‘fit’ (in terms of the prescribed benchmark) by the DPC.

Procedure to be followed by DPC in respect of government servants under cloud:
At the time of consideration of the cases of government servants for promotion, details of government servants in the consideration zone for promotion falling under the following categories should be specifically brought to the notice of the Departmental Promotion Committee:
i. Government servants under suspension;
ii. Government servants in respect of whom a charge-sheet has been issued and the disciplinary proceedings are pending; and
iii. Government servants in respect of whom prosecution for a criminal charge is pending.
The DPC shall assess the suitability of the government servants coming within the purview of the circumstances mentioned above along with other eligible candidates without taking into consideration the disciplinary case/criminal prosecution pending. The assessment of the DPC, including “Unfit for Promotion”, will be kept in a sealed cover.
The same procedure outlined in the above para will be followed by the subsequent Departmental Promotion Committees convened till the disciplinary case/criminal prosecution against the government servant concerned is concluded.
It has been decided that the “Sealed Cover Procedure” prescribed in the Department of Personnel and Training, OM No. 22011/4/91-Estt.(A) dated
14.9.1992 referred to above may be followed at the time of consideration for ad hoc promotion also in the case of government servants -
(i) who are under suspension;
(ii) in respect of whom a charge-sheet has been issued and the disciplinary proceedings are pending; and
(iii) in respect of whom prosecution for a criminal charge is pending.

Processing of recommendations of DPC :

The recommendations of the DPC are advisory in nature and should be duly approved by the appointing authority. A clearance from the Vigilance Section of the Office/Department should also be obtained before making actual promotion or confirmation of officer approved by DPC to ensure that no disciplinary proceedings are pending against the officer concerned. Promotion should be made strictly in the order in which the names of the officers appear in the panel.

Refusal of promotion:

When a government employee does not want to accept an offer of promotion, he may make a written request to that effect and the same will be considered by the appointing authority. If the reasons adduced for refusal of promotion are acceptable to the appointing authority, the next person in the select list may be promoted.

However, since it may not be administratively possible or desirable to offer appointment to the persons who initially refused promotion, on every occasion on which a vacancy arises, during the period of validity of the panel, no fresh offer of appointment on promotion shall be made in such cases for a period of one year from the date of refusal of first promotion or till a next vacancy arises, whichever is later.

On the eventual promotion to the higher grade, such government servant will lose seniority vis-a-vis his juniors promoted to the higher grade earlier irrespective of the fact whether the posts in question are filled by selection or otherwise. The above mentioned policy will not apply where ad hoc promotions against short-term vacancies are refused.

In cases where the reasons adduced by the officer for his refusal for promotion are not acceptable, the appointing authority should enforce the promotion of the officer and in case the officer still refuses to be promoted, then even disciplinary action can be taken against him for refusing to obey the orders of the appointing authority.

Validity of a panel:

The panel for promotion drawn up by DPC for 'selection' posts would normally be valid for one year. It should cease to be in force on the expiry of a period of one year or when a fresh panel is prepared, whichever is earlier.

The date of commencement of the validity of panel will be the date on which the DPC meets. In case the DPC meets on more than one day, the last date of the meeting would be the date of commencement of the validity of the panel. In case the panel requires, partially or wholly, the approval of the Commission, the date of validity of panel would be the date (of Commission's letter) communicating their approval to the panel.

It is important to ensure that the Commission's approval to the panel is obtained, where necessary, with the least possible delay.

ACPS-ADEQUATE CAREER PROGRESSION 6.1.15

Promotion policy exists to provide adequate career progression to the employees.

The Fifth CPC was of the opinion that the Government should formulate a promotion scheme that caters to the promotion aspirations of Central Government employees in general. They recommended the Assured Career Progression Scheme (ACPS) for the general employees in the Government. The Fifth CPC had also recommended use of cadre review mechanism to bring uniformity in the career prospects of Group A central services. Department of Personnel & Training (DOPT) was also advised to issue detailed guidelines for cadre reviews of posts belonging to Groups B, C & D so as to ensure timely review thereof.

The scheme of ACP recommended by the Fifth CPC envisaged three time bound promotions for Group A posts after 4, 8 & 13 years of service. For posts in Groups B, C & D, two time bound promotions were to be provided on completion of 8 & 16 years of service for Group B, 10 & 20 years for Group C and 12 & 24 years of service for Group D.

The Government accepted this recommendation in a modified manner and introduced the ACPS for Groups B, C & D and isolated posts in Group A where two financial upgradations were to be provided on completion of 12 & 24 years of service. The financial upgradations were to be in the next higher grade in the existing hierarchy.

Benefit of pay fixation under FR-22(1) (a) (i) was to be given at the time of these financial upgradations but no change in designation or functions accompanied such upgradation. The scheme, therefore, did not envisage a change in the status or rank of the employee who continued in the same post but only extended the next higher pay scale available in the hierarchy.

ACPS has, by and large, alleviated the problem of stagnation and also allowed higher rate of increments in the higher scale extended under it. However, it has given rise to many other problems, mainly because the financial upgradations in the extant scheme follow the existing hierarchy. This gives uneven benefit to employees existing in the same pay scale in different organisations with a different hierarchical pattern. Employees working in organisations having more intermediate grades suffer because financial upgradation under ACPS places them in a lower pay scale vis-à-vis a similarly placed employee in another organisation that has lesser intermediary grades. This, in a few cases also leads to a situation where the benefit of higher pay scale is not available because the next post in the hierarchy also exists in an identical pay scale. In such cases, benefit under ACPS is limited to increase in salary in the same pay scale on account of fixation under FR-22(1)(a)(i).

The Commission has received many representations seeking a uniform benefit under ACPS or seeking abolition of intermediary grades merely with a view to get higher jumps in pay scales under ACPS. While delayering of Government machinery is desirable and the Commission has made numerous recommendations to achieve the same, abolition of intermediary levels just to give better jumps under ACPS, even though the same are not desirable functionally, cannot be considered.

The only other way is to bring systemic changes in the existing scheme of ACPS so that all employees, irrespective of the existing hierarchical structure in their organisation/cadre, get same benefit under it. The Commission, therefore, recommends that the existing scheme of Assured Career Progression may, in future, be continued with two financial upgradations being allowed as at present with the following modifications:-

i) The scheme will also be available to all posts belonging to Group A - whether isolated or not. Organised Group A services will, however, not be covered under the scheme.

ii) Benefit of pay fixation available at the time of normal promotion shall be allowed at the time of financial upgradations under the scheme. Thus, an increase of 2.5% of pay and grade pay shall be available as financial upgradation under the scheme.

iii) The grade pay shall change at the time of financial upgradation under this scheme. The grade pay given at the time of financial upgradation under ACPS will be the immediate next higher grade pay in the hierarchy of revised pay bands and grade pay being recommended. Thus, grade pay at the time of financial upgradation under ACPS can, in certain cases where regular promotion is not between two successive grades, be different than what is available at the time of regular promotion. In such cases, the higher grade pay attached to the next promotion post in the hierarchy of the concerned cadre/ organization will be given only at the time of regular promotion.

iv) Financial upgradation under the scheme will be available whenever a person has spent 12 years continuously in the same grade. However, not more than two financial upgradations shall be given in the entire career as was provided in the extant scheme.

The scheme with aforesaid modifications shall be called modified ACPS and will ensure suitable progression uniformly to all the employees in Central Government. 6.1.16 Scientists and Doctors are presently covered under separate promotion schemes viz. Flexible Complementing Scheme and Dynamic Assured Career Progression Scheme respectively.

The Commission has considered these schemes in Chapters 3.5 & 3.6 of the Report. 6.1.17 Promotion channels are not very attractive for many posts in Groups B & C. Many times, highly qualified persons join these posts but get demoralized on account of prevailing stagnation. While running pay bands and Modified ACPS will address the problem of stagnation, the Commission is of the view that these employees need to be allowed a fast track promotion mechanism wherein the brighter employees will be able to get promoted faster, irrespective of their seniority, subject to their selection in the prescribed examination.

The Commission recommends that 10% of the vacancies hitherto filled by direct recruitment for all posts in Group B and C (apart from those in pay band PB-1 with grade pay of Rs.1800) will now be filled by Limited Departmental Competitive Examination (LDCE). All employees possessing minimum qualifications prescribed for direct recruitment shall be eligible for this examination irrespective of their present grade and the period of incumbency therein. Thus, even an employee in pay band PB-1 with grade pay of Rs.1800 will be eligible to appear in LDCE for a post in PB-2 with grade pay of Rs.4800 provided he/she possesses the necessary qualifications. This will be over and above any existing scheme of LDCE for filling up posts in various grades.
