Consequent upon the decision of the Central Vigilance Commission to withdraw the term stiff/severe minor/major penalty and Board's letter of even number dated 26.4.10 conveying the decision. Ministry of Railways (Railway Board) have decided to make certain changes to para 514.2 of Chapter-V, paras below (iv) and (ix) of 807 and para 821.2 of Chapter-VIII of the Indian Railways Vigilance Manual (2006 Edition), as per the enclosed Advance Correction Slip No.12.

Modification in Chapter-V, and VIII of Indian Railways Vigilance
Manual (2006 Edition)



     Ministry of Railways (Railway Board) have decided to make the following changes to para 514.2 Chapter V, paras below (iv) and (ix) of 807 and para 821.2 of Chapter VIII of the Indian Railways Vigilance Manual (2006 Edition).

1.      Modified para 514.2 : In the case of Group 'A' Officers, the power to impose a mojor penalty of Compulsory retirement Removal from service and Dismissal from service rests only with the President. In all such cases, the disciplinary case file is submitted to the Minister for Railways, to pass provisional orders, on behalf of the President. The case is, thereafter, referred to the UPSC for advice, alongwith all relevant records.

2.(i)   Modified para below (ix) of para 807 detailing on penalties under Discipline & Appeal : The penalties mentioned against (vii), (viii) and (ix) will be imposed only by the appointing authority or higher authority.

2(ii)   The para below (iv) of para 807stating that the penalties mentioned in (ii), (iii), (iii-b) & (iv) will be considered as stiff/severe minor penalties, stands deleted.

3.      Modified para 821.2 : The procedure brought about in para 821.1 above will also be followed in those cases also where the vigilance has recommended imposition of a major penalty of compulsory retirement/removal/dismissal from service, but the Disciplinary Authority/Appellate/Revisionary Authority, as the case may be, wishes to disagree and proposes to impose any of the other major penalties.

        Please refer to this Ministry's letter of even number dated 18.09.2009(S.No PC-V1/146, RBE No. 172/2009) on the subject mentioned above. ThePresident is pleased to decide that the Dearness Allowance payable to Railwayemployees shall be enhanced from the existing rate of 27%to 35% with effectfrom 1st January, 2010.

2. The provisions contained in Paras 3, 4 & 5 of this Ministry's letter of even number dated 09.09.2008 (S.No. PC-VI/3, RBE No. 106/2008) shall continue to be applicable while regulating Dearness Allowance under these orders.

3. The additional installment of Dearness Allowance payable under these orders shall be paid in cash to all railway employees. The payment of arrears of Dearness Allowance for the months of January and February, 2010 shall not be made before the date of disbursement of salary for March, 2010.

4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

Revision of hourly rates of incentive bonus and bonus factor

       Subject : Revision of hourly rates of incentive bonus and bonus factor of Workshops / PUs in respect of staff under CRJ pattern / GIS - Clarification.
       Ref: Board's letter of even no. dated 29.10.09.

        Vide Board's letter under reference, the revised hourly rates of incentive bonus and bonus factor of workshops / PUs were advised to the Railways. Some of the Railways have sought certain clarifications regarding implementation of above instructions. The details of issues raised the clarifications are given below:

        i. Issue: Date of revision of incentive bonus in case of SSE / SE (Grade Pay 4600).
        Clarification: The revised in case of SSEs / SEs (Grade Pay 4600) will be effective from 1.6.09.
        ii. Issue: Category of supervisors who are entitled for incentive.
        Clarification: SSEs / SEs directly supervising the staff working on the shop floor are entitled for payment of incentive bonus at a flat rate of 15% of the basic pay. For related issues, kindly refer to Board's letter No.99/M(Prod.)/814/35 dated 22.5.2000 and 16.3.2004.
        iii. Issue: Guidelines for reduction of 5% in allowed time.
        Clarification: Workshops / PUs may reduce the normalized time for individual activity in such a manner that the overall allowed time for that activity is reduced by 5%.
        iv. Issue: Payment of incentive to staff and supervisors on getting the benefit of Modified Assured Career Progression (MACP).
        Clarification: Incentive payment should be decided on the basis of the post/designation held by the employee and the hourly rate/bonus factor corresponding to that post/designation.

Railways to pay 75 days Productivity-linked bonus

The Railways have decided to pay its employees 75 days productivity-linked bonus for this year, according to railway ministry sources.

The bonus has been cleared by Railway minister Mamata Banerjee, the sources told newspersons in Kolkata today. The Railways had paid 73 days productivity-linked bonus last year.

Clarification regarding Anomaly in fixation for Loco Supervisory Staff in Railways

       Subject:Anomaly in fixation of pay of Loco Supervisory staff appointed prior to 01.01.2006 with reference to their juniors appointed after 01.01.2006 and drawing more pay than the seniors.

It has come to the notice of the Board that staff appointed prior to 1.1.2006 as Loco Running Supervisors in the pre-revised pay scales, whose pay has been fixed in the replacement pay structure for Loco Running Supervisors under the RS(RP) Rules, 2008, are drawing less pay than their juniors appointed as Loco Running Supervisor after 1.1.2006. The anomaly has arisen due to the fact that the benefit of element of Running allowance granted at the time of promotion of running staff to a stationary post has been granted to the junior in the revised pay structure, whereas, the same benefit granted to the senior is of lesser value as the same has been calculated on pre-revised pay scale.

2. It has been decided that the anomaly may be resolved by granting stepping up of pay in pay band to the seniors at par with the juniors in terms of Note 10 below Rule 7 of RS(RP) Rules, 2008.

3. . The benefit of stepping up of pay in pay band will be subject to the following conditions :-
(a) Both the junior and the senior Railway servants should belong to the same cadre and the posts in which they have been promoted should be identical in the same cadre and other conditions enumerated in Note 10 below Rule 7 of RS(RP) Rules, 2008 should also be fulfilled.
(b) The stepping up of pay will be allowed to running staff only appointed as Loco Supervisors in whose cases 30% of basic pay is taken as pay element in the running allowance. The stepping up of pay will not be admissible to the non- running staff of Mechanical Deptt. appointed as Loco Running Supervisors as in their cases the question of pay element in the running allowance does not arise;
(c) If even in the lower post, revised or pre-revised, the junior was drawing more pay than the senior by virtue of advance increments granted to him or otherwise, stepping up will not be permissible;
(d) Stepping up will be allowed only once, the pay so fixed after stepping up will remain unchanged;
(e) The next increment will be allowed on the following 1st July, if due, on completion of the requisite qualifying service with effect from the date of refixation of pay, as per the provisions of Rule 10 of RS(RP) Rules, 2008.

4. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.

       Subject: Encashment of Leave on Half Average Pay (LHAP) on permanent absorption in Public Sector Undertakings (PSU) / Autonomous Bodies – Regarding.

In terms of the instructions contained in this office letter of even number dated 8.10.2008, both Leave on Average Pay and LHAP are to be considered for encashment at the time of retirement, subject to the overall limit of 300 days

2. The matter regarding applicability or otherwise of the instructions dated 8.10.2008 referred to above in cases of permanent absorption of railway employees in PSUs / Autonomous Bodies, has been examined in consultation with the Department of Personnel & Training, the nodal Department of the Government in the matter, and it is clarified that the instructions dated 8.10.2008 ibid are not applicable in the case of permanent absorption of railway employees in PSUs/Autonomous Bodies. In other words, the existing provision of forfeiture of LHAP standing at the credit of such railway servants on absorption in PSUs/Autonomous bodies shall continue to be in force.

1.7 lakh vacancies in Railways, Mamata informs Rajya Sabha



Indian Railways has over 1.7 lakh vacancies which will be filled after the current recruitment process is reviewed, railway minister Mamata Banerjee informed the Rajya Sabha on Friday.

Replying to questions, she said the Railway Recruitment Board (RRB) is being reviewed. "We have to examine(the recruitment process) and address lacunae. We will come back once we have done the review."

She said there were issues of regional aspirations and problems in Maharashtra, Karnataka and Guwahati over RRB exams. "We are reviewing the entire process."

Of the total sanctioned strength of 15,66,964 employees, there were 1,72,444 vacancies, she said. Most of the vacancies were in Group 'C' at 1,12,566, followed by Group 'D' at 58,329. There are 1,549 vacancies in A and B, she said.

"Any large organisation like the Railways will have certain vacancies at any point of time. Arising of and filling up of vacancies is a continuous process," she said. "Vacancies arise due to normal retirement, voluntary retirements, deaths, promotions or creation of posts. Vacancies are filled primarily through open market recruitment and promotions."

To a separate question, she said there was a backlog of 1,814 vacancies of SCs in Group 'C' service of the Railways and 1,688 for STs. There is no backlog of vacancies of SC and ST in recruitment for Group A and B.

Encashment of Leave on Average Pay (LAP) while availing Railway Passes / PTOs

Sub: Encashment of Leave on Average Pay (LAP) while availing Railway Passes / PTOs

The Department of Personnel & Training (DOP&T), in consultation with the Ministry of Finance after examining references received from various Ministries/Departments citing practical problems faced by them as the facility of LTC is also admissible while availing causal leave, have issued instructions permitting Government Servants encashment of earned leave upto 10 days at the time of availing LTC without any linkage to the number of days and the nature of leave availed while proceeding on LTC.

2. The matter has been considered by the Board and in partial modification of the earlier instructions contained in letters of even number dated 29.10.2008 & 03.12.2008, it has been decided to permit Railway servants encashment of LAP upto 10 days without any linkage to the number of days and nature of leave availed at the time of availing Passes/PTOs.

3. These orders shall be effective from the date of issue of this letter.

4. Formal amendment to the Railway Services (Liberalised Leave) Rules, 1949, of the Indian Raiway Establishment Code Vol. I, 1985 Edition (Second Re-print Edition 2003) will be issued separately.

5. Please acknowedge receipt.

Recommendations of the VI CPC - Decision relating to grant of PCO allowance

Subject : Recommendations of the VI Central Pay Commission - Decision relating to grantof PCO Allowance to staff of Production Control Organisation.
Ref: Board's letter of even number dated 6.2.09.

With reference to Board's above quoted letter, a doubt has been raised by some of the Associationsas to whether Junior Engineers I & II drawing grade pay Rs. 4200 will be covered by the instructionscontained in Board's letter dt. 6.2.2009 for payment of P.C.O. Allowance @ 15%.

2. It is clarified that PCO Allowance may continue to be paid @ 15% to non-supervisory staff and JE-I & II drawing grade pay upto Rs.4200 and @ 7.5 % to SEs and SSEs drawing grade pay fo Rs.4600

3. This issues with the concurrence of the Finance Directorate of the Ministry of Railways.
